General terms and conditions of sale
The present general conditions of sale apply to sales made between La Roseraie du Val’Ensoleillé gîte, located at La roseraie _ Lieu-dit du Bars _ 04210 Valensole, and the Client.
RESERVATION & DEPOSIT
The rates communicated are public, in €, taxes and services included, except for the tourist tax which will be paid on site. The amount of the tourist tax is likely to vary according to the legal provisions that may be taken. The package rates (electric charging point, cleaning costs, etc.) are made up of inseparable elements and are not refundable in the event of non-use. The price of the gite(s) agreed upon at the time of booking and paid by the client is the final price. The client may not claim a change in the price of the confirmed reservation in the event of subsequent promotions offered by the establishment via its reservation service, its website or other partner sites. All reservations will be confirmed after receipt of a first deposit, and the balance due upon arrival of the client according to the following conditions:
A deposit of 30% of the total amount of the stay at the time of booking
The balance must be paid on the client’s arrival
The payment of the first deposit confirms the reservation and thus implies the acceptance of our general terms and conditions of sale and cancellation. If the balance due is not paid on the agreed date, the stay will be considered as cancelled by the client and the terms and conditions of sale will apply accordingly.
In the case of payment by bank transfer or credit card, the bank charges must be paid by the client, and added to the total amount of the stay. No payment in foreign currencies can be accepted.
MODIFICATION & CANCELLATION OF THE STAY
Modification of the stay
All requests for changes to the dates of stay or cancellations must be notified to the reservations department in writing in advance. These requests will be subject to the cancellation policy.
Interruption of the stay and unused services
Any stay interrupted by the client or any services booked and not consumed/used due to the client, for any reason whatsoever, including medical reasons and force majeure, will not give rise to any refund.
Cancellation by the customer
In the event of a “no show” or inability to arrive on the day of arrival, the charge will be 100% of the nights concerned. In the event of a no-show, the guest has 24 hours to notify the hotel of a new arrival date. After 24 hours, the hotel reserves the right to re-sell the room.
We advise clients to take out a policy with their insurance company to cover cancellation costs.
All reservations will be subject to the following cancellation policy :
Any cancellation must be notified to the owner, with acknowledgement of receipt.
a) cancellation before arrival :
the deposit remains with the owner. The owner may ask for the balance of the stay if the cancellation occurs less than 30 days before the planned date of arrival.
If the tenant does not show up within 24 hours of the arrival date indicated on the contract, the present contract becomes null and void and the owner may dispose of the gîte. The deposit also remains with the owner who will ask for the balance of the rental.
b) if the stay is shortened, the price of the rental remains with the owner. No refund will be made.
Special policy COVID-19 :
Cancellations related to COVID-19 are possible with a deferral of the reservation amount or with a refund in the following cases :
- If the French government decides to close the French borders, a refund is possible.
- If the customers’ government decides to close its borders, a postponement is possible.
- If travellers test positive for Covid-19 less than 24 hours before arrival, a deferral is possible, until the end of the 2023 summer season or, on request, the 2023-2024 winter season; subject to the following conditions:
– At the time of booking, the names and passports of each traveller must be provided
– At the time of booking, it is compulsory to provide the names and passports of each traveller: – Send the positive test proof in the name of the person in French or English
If these items are not provided at the time of confirmation of the booking, no cancellation will be possible in the event of a positive test.
Cancellation by the hotelier :
The reservation contract may be terminated by the hotel owner, without this giving rise to the payment of damages to the client, in the event of an event constituting force majeure, or in the event of the hotel being unable to operate. Any deposits paid by the client will be refunded.
CONDITIONS OF STAY & LIABILITY
Responsability
During the whole stay, children are under the responsibility of their parents. Do not allow children to walk and/or bathe alone without being accompanied by their parents or a responsible adult.
Under no circumstances shall the lessor be held responsible for any accidents or damage that may occur on the property of the Roseraie du Val’Ensoleillé.
Conclusion of the contract
The reservation becomes effective as soon as the tenant has sent the owner the deposit indicated at the time of the reservation as well as a copy of the contract signed before the deadline indicated. A second copy must be kept by the Tenant.
The rental concluded between the parties to the present contract cannot in any case benefit even partially to third parties, natural or legal persons, except with the written agreement of the owner.
Any infringement of this last paragraph could lead to the immediate cancellation of the rental at the expense of the tenant, the proceeds of the rental remaining definitively with the owner.
At the time of booking, you will be asked for the number of persons – adults and children – occupying the room as well as the surnames and first names of each. Under no circumstances may the number of persons exceed the maximum capacity of the room.
Children under the age of 2 years are free of charge.
Animals are not accepted.
The tenant must arrive on the day specified in the time slot mentioned on this contract. In case of late or delayed arrival, the tenant must inform the owner. In case of non-information and non-respect of the time slot, additional costs corresponding to the rate of the extra night will be charged to the client.
Arrival : 4 PM Departure : 10 AM
The extras consumed by the clients must be paid on the day of departure by credit card or in cash to the host.
The Client undertakes to respect the private and common areas and will be held responsible for any damage caused by him. Any behaviour contrary to good morals and public order will lead the hotel management to ask the Client to leave the establishment without any compensation or reimbursement.
A set of rules and regulations for good conduct is available in the hotel. We thank you for taking note of them and for respecting them.
State of play
An inventory is drawn up jointly and signed by the tenant and the owner or his representative on arrival and departure. This inventory is the only reference in the event of a dispute concerning the state of the premises.
The state of cleanliness of the gîte on the tenant’s arrival must be noted in the inventory of fixtures.
In the event of abnormal use of the premises, or exceptional soiling, the amount of the cleaning costs will be invoiced to the tenant.
Deposit
On the arrival of the Tenant, a deposit, the amount of which is indicated on the front of this contract, is requested by the owner. After the inventory of fixtures at the end of the rental period has been drawn up, this deposit will be returned, less the cost of repairing the premises if any damage has been found.
In case of early departure (before the time mentioned on the present contract) preventing the establishment of the inventory of fixtures on the day of the tenant’s departure, the deposit is returned by the owner within a period not exceeding one week.
Payment of charges
Water and electricity charges are included in the rental price for normal use.
Claims
Your satisfaction is our priority. If you have any complaints, it is important to mention them to the host when you arrive, or afterwards, any complaints should be made in writing within 10 days.
Any request for a specific orientation or characteristic of the accommodation is considered as a preference and does not constitute a contractual guarantee. They do not give any right to compensation.
Any dispute concerning the interpretation and execution of these conditions and which could not be settled amicably will be under the exclusive jurisdiction of the Commercial Court of Manosque and will be governed by French law.
